গতকাল প্রথম আলোতে শাহদীন মালিকের লেখাটি পড়ছিলাম। পড়তে পড়তে হঠাৎ কৌতুহল হল বিশ্বের অন্যান্য ইসলামিক দেশের সংবিধান কেমন সেটা দেখতে। সবার সংবিধানের শুরুতে কি "বিসমিল্লাহির রাহ্‌মানির রাহিম" আছে? নেট ঘেঁটে কয়েকটা দেশের সংবিধানের শুরুটা দিলাম এখানে। তবে বঙ্গানুবাদ করলাম না বলে দুঃখিত। সাধারণতঃ সংবিধানের পরিভাষাগুলো একটু কঠিন হয়ে থাকে। তাই ঐ চেষ্টায় গেলাম না।

Article 1 [Form of Government]
The form of government of Iran is that of an Islamic Republic, endorsed by the people of Iran on the basis of their longstanding belief in the sovereignty of truth and Koranic justice, in the referendum of 29 and 30 March 1979, through the affirmative vote of a majority of 98.2% of eligible voters, held after the victorious Islamic Revolution led by Imam Khumayni.

আমাদের সংবিধানে ইসলামী আইনের ব্যাপারে কিছু বলা নেই। তবে প্রধান চার ধর্মের আলাদা আলাদা পারিবারিক ও উত্তরাধিকার আইনের কথা বলা আছে।

একাত্তরের পরবর্তী সময় থেকে আজ পর্যন্ত ধর্ম নিয়ে একটা বিতর্ক চলে আসছে আমাদের দেশে। যারা ধর্মনিরপেক্ষতা চাচ্ছে তারা এটাকে মুক্তিযুদ্ধের চেতনা বলে দাবী করছে। আমরা ছোটবেলা থেকে মুক্তিযুদ্ধের ইতিহাস যা জেনেছি তাতে ২৬শে মার্চের আগ পর্যন্ত ধর্ম নিয়ে কোন আলোচনা শেখ মুজিবুর রহমান বা আর কাউকে করতে দেখিনি, ছয় দফাতেও সেটা নিয়ে কোন উল্লেখ দেখিনি। ১৭ই এপ্রিল মুজিব নগর সরকার গঠনের সময় এটা নিয়ে কোন আলোচনা হয়েছিল কিনা আমার জানা নেই। হয়তো ঐ সময়ের কেউ যারা একেবারে অস্থায়ী সরকারের কাছে ছিল তারা বলতে পারবে। তাহলে শুধুমাত্র যুদ্ধকালীন সময়ে কিছু দুষ্কৃতিকারীর ইসলামের নাম ভাঙ্গিয়ে অপকীর্তির কারণে রাতারাতি মুক্তিযুদ্ধের চেতনা পাল্টে গিয়েছিল? এ কেমন কথা? কিছু মানুষ ইসলামের গায়ে দাগ লাগিয়েছিল, তাই সংখ্যাগরিষ্ঠ মুসলমানের দেশে সবাই ইসলামী শাসনকে খারাপ ভাববে, এটা কেমন যুক্তি? তার আগের ২৪ বছরের শাসনামলে ইসলামের নামে কি কি খারাপ কাজ হয়েছিল? অবশ্য ঐ সময়ে বামপন্থীদের রাজনীতি নিষিদ্ধ ছিল বলে তারা আওয়ামী লীগের আড়ালে সক্রিয় ছিল। তত্ত্বাবধায়ক সরকারের আমলে একটা টিভি টক শোতে এক সিপিবি নেতা বলেছিলেন আওয়ামী মুসলিম লীগের নাম আওয়ামী লীগ করার ব্যাপারেও সিপিবির নেতাদের অবদান ছিল। ঐ একই টক শোতে আরেকজন নেতা বলেছিলেন রাশিয়াতে সমাজতন্ত্র পতনের মূল কারণ ১৯৫৬তে সমাজতন্ত্রের মাঝে কিছু কিছু গণতান্ত্রিক ভাবধারা ঢোকানো হয়েছিল। তাই এই ধর্মনিরপেক্ষতার দাবী কি মূলত বামদেরই ছিল? বঙ্গবন্ধু এবং অন্যান্য আওয়ামী নেতাদের একাত্তরের আগ পর্যন্ত ধর্মের ব্যাপারে কি মনোভাব ছিল? গণতন্ত্র বা সমাজতন্ত্রের ব্যাপারেই বা মুক্তিযুদ্ধের আগে বা চলা অবস্থায় কোন আলোচনা হয়েছিল? গণতন্ত্রের মাঝে সমাজতন্ত্র কিভাবে কাজ করবে, কোথায় কোথায় কাজ করবে, এ ব্যাপারে কোন ধারণা আছে কারো? যতদূর মনে করতে পারছি ৭২ এর সংবিধান রচনার পরে একটা সম্পাদকীয়তে মাওলানা ভাসানীও এর সমালোচনা করেছিলেন। আমরা আজকের প্রজন্ম সত্যিকারের ইতিহাসটাই জানতে চাই।
