This is written in response/answer to the blog Click This Link with the title “ইসলামে দাসী ও যুদ্ধলব্ধ গণিমতের নারীরাকি বর্বরতার শিকার?”


I was losing temper while reading these hadiths are quoted. It is not like that I did not know these hadith before, indeed I know these very well. Whenever I read I had the same feelings. However, after reading the last passage, where the blogger writes “আমি ইসলামের বিরোধীতা করছিনা, হাদীস পড়ে আমি বলছি এই যদি হয় শান্তির ধর্মের মানুষের আচরণ তাহলে ভাবতে হবে হাদীস গুলো আদৌ সঠিক না জাল? যদি জাল হয়ে থাকে তবে আজও কেন বহাল তবিয়তে এই হাদীস গুলো বইয়ের পাতায় জায়গা করে আছে? কারা এইসব দেখবে?”, I understand the quest and feel to reply it. Since the reply is quite long, instead of posting in comment box, I post it in my own blog. Readers are requested first to visit that blog and read these hadith first (Click This Link) so that they can understand what I am talking about.

If I explain it why these hadith is absolute fabricate, it will need much explanation and it becomes a sizable book. So I will try to keep it short and of course if you have any question, you can ask me again.

I am not going in to details of the history of hadith collections, its criteria set, isnad (chain of narration) and motives. Rather, What I will say, no one including all those hadith writers is infallible. Only infallible is Allah and His word Quran.

Since Quran is complete, detailed, self-explanatory, easy to understand and remember (Please see Click This Link) and the prophet followed, taught only Quran, and judged by Only Quran (Please see Click This Link), we have absolutely no reason to believe that the prophet could say or did anything that contradicts with Quran. And Allah says Quran as “Furqan”-the criterion, We use the Quran as a criteria to judge these hadith. Therefore, anything that contradicts with Quran, no matter who record it, which book it is written, the prophet never uttered such word, can never be the part of religion of Islam.


Now let’s see how these hadith contradict with Quran:

1. For Captive Women:
Allah says: Therefore, when ye meet the Unbelievers (in fight), smite at their necks; At length, when ye have thoroughly subdued them, bind a bond firmly (on them): thereafter (is the time for) either generosity or ransom: Until the war lays down its burdens. Thus (are ye commanded): but if it had been Allah's Will, He could certainly have exacted retribution from them (Himself); but (He lets you fight) in order to test you, some with others. But those who are slain in the Way of Allah,- He will never let their deeds be lost (47:4)

What Allah says for war captive that they should be freed as soon as the war was over either by
• generosity or
• by taking ransom

There is no third option. So how come the question of sex arise? Don’t you think the prophet did not knew it who only followed Quran? Then how come the exalted prophet gave permission to have sex with them if he follow only Quran. So, who do you believe Al Quran or Al Bukhari? Interestingly, these fabrication has a vast consequence in our own country’s history in 1971 as well. I can understand the impact what consequence bring such fabrication.


2.Slaves:
Islam never promotes slavery neither allowed to have it. Since, only master is Allah, there cannot be two master: one is Allah and one is human master for salves. Allah says in Quran…….

It is not (possible) for any human being unto whom Allah had given the Scripture and wisdom and the prophethood that he should afterwards have said unto mankind: Be slaves of me instead of Allah; but (what he said was): Be ye faithful servants of the Lord by virtue of your constant teaching of the Scripture and of your constant study thereof.(3:79)


Did we not show him the two paths? He should choose the difficult path. Which one is the difficult path? The freeing of slaves. Feeding, during the time of hardship... (90:10-14)


Righteousness is not turning your faces towards the east or the west. Righteous are those who believe in God, the Last Day, the angels, the scripture, and the prophets; and they give the money, cheerfully, to the relatives, the orphans, the needy, the traveler, the beggars, and to free the slaves... (2:177)

The Quran lists the penalty for various misdemeanors as freeing of slaves, see 4:92, 5:89, 58:3. It also implies distribution of community/collective charities would contribute towards freeing of slaves:

The charities are to go to the poor, and the needy, and those who work to collect them, and those whose hearts have been united, and to free the slaves, and those in debt, and in the cause of God, and the traveler. A duty from God, and God is Knowledgeable, Wise. (9:60)

So, from these above verse from Quran, we have reasons to believe that neither the prophet nor his companion or believers allowed slaves in their home. So, the concept/ practice of keeping slaves does not arise in Muslim community. Interestingly, a detailed chapter was written by Imam Malik regarding how to trade slaves, sex with them. On top of it, one hadith makes the prophet a slave trader. How much insult they can do to the exalted prophet? Yet, you people believe it?

3. Women that your right hand possess (4:24-25):
Also (prohibited are) women already married, except those whom your right hands possess: Thus hath Allah ordained (Prohibitions) against you: Except for these, all others are lawful, provided ye seek (them in marriage) with gifts from your property,- desiring chastity, not lust, seeing that ye derive benefit from them, give them their dowers (at least) as prescribed; but if, after a dower is prescribed, agree Mutually (to vary it), there is no blame on you, and Allah is All-knowing, All-wise (4:24)

If any of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess: And Allah hath full knowledge about your faith. Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practice self-restraint. And Allah is Oft-forgiving, Most Merciful. (4:25)

In 4: 24, what does the phrase “your right hands possess” means? Since the treatment of captives is given in 47:40 (see above) and slaves are not allowed in Muslim community (as proven above) then who do the phrase apply? The answer is given in the verse 60:10

O ye who believe! When there come to you believing women refugees, examine (and test) them: Allah knows best as to their Faith: if ye ascertain that they are Believers, then send them not back to the Unbelievers. They are not lawful (wives) for the Unbelievers, nor are the (Unbelievers) lawful (husbands) for them. But pay the Unbelievers what they have spent (on their dower), and there will be no blame on you if ye marry them on payment of their dower to them. But hold not to the guardianship of unbelieving women: ask for what ye have spent on their dowers, and let the (Unbelievers) ask for what they have spent (on the dowers of women who come over to you). Such is the command of Allah: He judges (with justice) between you. And Allah is Full of Knowledge and Wisdom. (60:10)

So if we read verse 4:24-25 and 60:10 together, we can say the following things…The expression “Ma malakat aymanukum” has been translated by most translations as "whom your right hands possess" or "captives" or "concubines." The similar expressions found in 4:3,24,25,36; 16:71; 23:6; 24:31,33,58; 30:28; 33:50,52,55; and 70:30.
These were the wives of the enemy combatants who were persecuted because they acknowledged the message of Islam and sought asylum at the Muslim community (60:10). So, the more accurate meaning of this phrase would be “Those who maintained by your oath or those with whom you have contractual rights”

Now, to make it more clarify, another verse from Quran is given:
O Prophet, indeed We have made lawful to you your wives to whom you have given their due compensation and those your right hand possesses from what Allah has returned to you and the daughters of your paternal uncles and the daughters of your paternal aunts and the daughters of your maternal uncles and the daughters of your maternal aunts who emigrated with you and a believing woman if she gives herself to the Prophet [and] if the Prophet wishes to marry her, [this is] only for you, excluding the [other] believers. We certainly know what We have made obligatory upon them concerning their wives and those their right hands possess, [but this is for you] in order that there will be upon you no discomfort. And ever is Allah Forgiving and Merciful.(33:50)


Now conclude from the 4:24-25, 60:10,33:50 verse.

1. Already married women are prohibited to marry (4:24)
2. The phrase “Ma malakat aymanukum” clearly refers to those women who have sought asylum with the believers against their disbelieving husbands at war with the believers. It does not anyway mean female captives or slaves (60:10).
3. Marriage is pre-requisite to do sex with them (4:25, 60:10)
4. If a refugee believing women come to you from her unbelieving husband, you are allowed to marry them. Since they did not get through a normal divorce process, an exceptional contract allows them to marry Muslims as free women, Not just doing sex. (60:10)
5. If you cannot marry a free believing man, you can also marry women who you possess by right hand (see point no 2-4), or you can marry a believing salve girl. (4:25)
6. To do sex with a slave girl who is under other’s control (since Muslim cannot have slave as mentioned earlier) you have to first marry them by taking permission from their owner and give proper dowry (4:25)
7. If you read verse 33:50 that mention which women are lawful to believers, you should not have any difficulty to understand that here lawful women means marriage (the right hand possess is also one of them), not doing sex without marriage

Conclusion:
The hadith that are mentioned regarding doing sex with slaves, and captives directly contradicts with Quran. Since the prophet never taught, followed and judged by anything except Quran, therefore we have no reasons to believe that these are saying or deed of the exalted prophet. These are gross lies against the exalted prophet and fabricated no matter who narrates it and which book it appears.

Those who are still not convienced and reluctant to say these hadith are fabricated, I have only one question to them.
If the Quran which is Allah’s word contradict with the hadith that is man-made, which one will you believe?
