শ্রমের বহুস্তর সুবিধা (multi level benefit of labour) এক প্রকার জুয়াবাজী। আল্লাহ বলেন,
يا ايها الذين امنوا انما الخمر و الميسر .......... رجس من عمل الشيطان فاجتنبوه لعلكم تفلحون (المائدة 90)
অর্থ্যাৎ, হে ঈমানদাররা! নিঃসন্দেহে মদ, জুয়া …………… নাপাক ও শয়তানী কাজ। অতএব, এগুলো পরিত্যাগ কর; তবেই তোমরা সফল হতে পারবে। (মায়িদাহ ৯০)

ইসলামে যে সকল কারণে জুয়াবাজী ও লটারী নিষিদ্ধ, তার অন্যতম হচ্ছে অল্প কিছু টাকা ও শ্রম বিনিয়োগ করে অসংখ্য লোকের জমা দেওয়া বিশাল অংকের টাকা লাভ করা। এ পদ্ধতিতে শ্রমের সাথে ফলের কোন রকমের সামঞ্জস্যতা নেই (যেমন, ১০ টাকার টিকিটে ৪০ লক্ষ টাকা জেতা)। তাছাড়া, এর ফলে লক্ষ লক্ষ লোকের অন্তরে (যারা লটারী জিততে পারেনি) ব্যাপক হতাশার সৃষ্টি হয়। এ সকল কারণে ইসলাম এ সিস্টেমকে “অন্যের সম্পদ অন্যায় ভাবে খাওয়ার” শামিল করে।

আপলাইনের দালালরা ডাউনলাইনের দালালদের বিক্রি থেকে “তত্ত্বাবধানের” নাম দিয়ে যে বিশাল কমিশন ভোগ করে – তাকে সুস্পষ্ট জুয়াবাজী ও “অন্যায়ভাবে অন্যের সম্পদ ভোগ” (اكل اموال الناس بالباطل) –এর অন্তর্ভূক্ত করেছেন ইসলামী আইনের পণ্ডিতেরা। এক্ষেত্রে ওআইসি’র ইন্টারন্যাশনাল ফিকহ একাডেমীর চীফ স্কলার প্রফেসর ড. আব্দুস সাত্তার আবু গুদ্দাহ’র বক্তব্য প্রণিধানযোগ্য। তিনি বলেন “...compound brokerage falls under the category of eating up another’s property unjustly and has an element of gambling in it. The main factor that contributes to this is the fact that compound brokerage automatically implies that a portion from the sales of the down line will be channeled to the up line.”

মালয়েশিয়ার বিশিষ্ট পণ্ডিত জাহারুদ্দিন আব্দুর রহমান মাল্টি লেভেল মার্কেটিংয়ের আপলাইন কর্তৃক সুদূর-বহুদূর পর্যন্ত ডাউনলাইনের কমিশন ভোগকে হারাম গণ্য করে বলেন,
“Generally, commission that is earned through sales of goods and services (like brokerage fee) is permissible in Islam. …However the commission in MLM and pyramid schemes may convert to haram status if (1) sales commission of the network is tied to his/her personal sale….” (2) Commission originates from an unknown down line because the network is too big. As a result, the upline seem to enjoy commission without the need to put any effort. This could be classified as compound brokerage (broker on broker on broker…) which falls under the category of eating up another’s property unjustly and has an element of gambling in it.”

ইন্টারন্যাশনাল ফিকহ একাডেমী কর্তৃক প্রদত্ত একটি ফতোয়ায় (legal verdict) মাল্টি লেভেল মার্কেটিং কে হারাম ঘোষণা করে বলা হয়েছে যে, এ সিস্টেমে আপলাইনের দালালদেরকে যে কমিশন দেয়া হয় তা বৈধ দালালীর ফি’র (brokerage fee) অনুরূপ নয়; কারণ এর মধ্যে জুয়াবাজী নিহিত রয়েছে। (...that the commission paid is not like a brokerage fee, because it involves activities similar to gambling) ।
